Terms of Service

Important notice: JDMarket is an independent tool and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Facebook in any way. "Facebook Marketplace" is a trademark of Meta Platforms, Inc.

Please read these Terms of Service ("Terms") carefully before using JDMarket ("the Service", "we", "us", "our"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Two versions of JDMarket. JDMarket Alerts is a fully managed service used through our mobile apps and website — our own servers retrieve publicly visible Facebook Marketplace listings, and you install nothing. The legacy Desktop Agent is a separate downloadable application that some existing users run on their own computer. Sections below note where a term applies only to one version.

1Section 1

Description of Service

JDMarket is a software-as-a-service (SaaS) platform that helps you discover and get alerted to publicly visible listings on Facebook Marketplace. Depending on which version you use, the Service includes:

  • JDMarket Alerts (managed): our servers retrieve publicly visible Marketplace listing data on your behalf — you install no software, and no Facebook account, login, cookies, or session of yours is used or required.
  • Saved searches and alerts that run at scheduled intervals and notify you when new matching listings appear.
  • AI-powered filtering that evaluates listings against natural-language criteria you provide.
  • Notifications delivered by mobile push, and optionally by Telegram, when new matching listings are found.
  • Mobile apps and a web dashboard for managing searches, alerts, favorites, and account settings.
  • Legacy Desktop Agent (optional): a downloadable application, described in Section 8, that some existing users run on their own computer.

The Service is intended for personal use to help individuals find listings of interest. It is not a bulk data-collection or commercial-redistribution tool.

2Section 2

Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the Service. By registering, you represent and warrant that you meet these requirements. You are also responsible for ensuring that your use of the Service complies with all laws applicable in your jurisdiction.

3Section 3

Acceptable Use

You agree to use the Service only for lawful personal purposes. You must not:

  • Use the Service to collect data for commercial resale, redistribution, or mass harvesting without our prior written consent.
  • Use the Service to harass, stalk, monitor, or harm any individual.
  • Attempt to reverse-engineer, decompile, copy, or reproduce any part of the Service or its underlying code.
  • Use automated scripts, bots, or tools to access, scrape, or interact with the Service or its API outside the interfaces we provide.
  • Circumvent, disable, or interfere with any security features, rate limits, or access controls of the Service.
  • Share your account credentials, API tokens, or authentication with any third party.
  • Use the Service in any manner that violates applicable local, national, or international law.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Violation of these rules may result in immediate account suspension or termination without refund.

4Section 4

Account Registration & Security

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized access to your account.

You may not create multiple accounts to circumvent plan limits or access restrictions. We reserve the right to merge or terminate duplicate accounts.

5Section 5

Subscriptions & Billing

JDMarket Alerts is a paid subscription (the Pro plan), offered monthly or annually. A new account is not active until you choose a plan and add a payment method. Depending on your platform, billing is handled by Apple In-App Purchase (on iPhone and iPad) or by our web checkout provider, Stripe (on Android and on our website).

  • Free trial (monthly plan only): the monthly plan begins with a 3-day free trial. A payment method is collected up front (by Apple on iPhone/iPad, or by Stripe on Android/web), but no charge is made during the trial. If you do not cancel before the trial ends, the subscription converts to recurring monthly billing. The annual plan has no free trial and is charged in full at the time of purchase.
  • Monthly Pro: after the 3-day trial, billed every 30 days at the then-current monthly rate shown at checkout.
  • Annual Pro: billed once at purchase for a 12-month period at the then-current annual rate shown at checkout.

Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (every 30 days for monthly, every 12 months for annual) at the then-current rate, until you cancel. You authorize the applicable processor — Apple (on iPhone/iPad) or Stripe (on Android/web) — to charge your payment method on this recurring basis. You can cancel at any time: Apple-billed subscriptions from your device's Subscriptions settings, and Stripe-billed subscriptions from your profile or billing portal (see Section 6). Cancellation stops the next renewal. Current prices are shown on our pricing page and at checkout, in USD unless otherwise stated; applicable taxes may be added based on your location.

Where you can subscribe. On iPhone and iPad, subscriptions are sold through Apple In-App Purchase and managed in your device's Subscriptions settings. On Android and on our website, subscriptions are sold through secure web checkout (Stripe) and managed from your profile or billing portal, or at jdmarket.cc.

Price changes. We may change pricing at any time. We will give existing subscribers at least 14 days' notice before a price increase takes effect.

Payments are processed securely by Apple (iPhone/iPad in-app purchases) or Stripe, Inc. (Android and web). We never store your full credit card number or payment details on our servers. Stripe billing information is governed by Stripe's Privacy Policy; Apple purchases are governed by Apple's terms.

6Section 6

Refunds & Cancellations

You may cancel your subscription at any time from your profile page or billing portal. Cancellation takes effect at the end of your current billing period — you retain Pro access until then. Cancelling during the free trial avoids any charge. We do not offer prorated refunds for unused time on monthly plans.

Annual plans: if you cancel an annual plan within 7 days of the initial purchase and have not made substantial use of the Service, you may request a full refund by contacting [email protected]. After 7 days, annual plans are non-refundable.

We may grant refunds at our discretion on a case-by-case basis for exceptional circumstances. Nothing in this section limits any non-waivable refund or withdrawal rights you may have under the consumer-protection laws of your country or state.

7Section 7

Third-Party Platforms & Sellers

The Service retrieves publicly available listing data from Facebook Marketplace, a third-party platform operated by Meta Platforms, Inc. JDMarket is independent and is not affiliated with, endorsed by, or sponsored by Meta. You acknowledge and agree that:

  • The Service gives you information about public listings; you are responsible for how you use that information, including any contact, negotiation, purchase, or other dealing you undertake directly with a seller on Facebook or elsewhere.
  • JDMarket makes no representation that any listing is accurate, available, lawful, or suitable, and is not a party to any transaction between you and a seller.
  • Meta may modify, restrict, rate-limit, or shut down its platform at any time, which may degrade or disable the Service. JDMarket is not liable for any interruption resulting from such changes.
  • "Facebook Marketplace" is a trademark of Meta Platforms, Inc.; we reference it only to describe the source of the public listings the Service surfaces.
8Section 8

How the Service Works

JDMarket Alerts (managed). You use JDMarket Alerts through our mobile apps or website. Our own servers and infrastructure retrieve publicly visible Facebook Marketplace listings that match your saved searches, apply your filters, and send you alerts. You install no software, and no Facebook account, login, cookies, or session of yours is used or required. All communication between the apps and our servers is encrypted (HTTPS).

Legacy Desktop Agent (optional; existing users only). Some users run our separate downloadable Desktop Agent on their own computer. Where you choose to use the Desktop Agent, it runs locally and uses your own logged-in browser session. You are responsible for keeping that computer secure and for your own use of any third-party account through it. The Desktop Agent only browses listing pages — it does not post, message, buy, or otherwise interact with listings.

We may release updates to the apps and the Agent from time to time. Continued use of the Service may require installing available updates.

9Section 9

Data Accuracy

The Service retrieves and displays listing data as it appears publicly on Facebook Marketplace at the time it is retrieved. We do not verify the accuracy, completeness, availability, or legality of any listing. JDMarket makes no warranty that listing data is accurate, current, or complete.

Listings may be removed, altered, or sold between the time they are retrieved and the time you view them. You assume full responsibility for any decisions — financial or otherwise — made based on information obtained through the Service.

10Section 10

Service Availability

We strive to maintain reliable uptime, but we do not guarantee that the Service will be available at all times. The Service may be suspended, modified, or discontinued at any time — for maintenance, technical issues, changes by Meta or our infrastructure providers, or other reasons — without prior notice. We are not liable for any losses resulting from service interruptions, downtime, failed or incomplete alerts, or discontinuation. See also the Force Majeure provision in Section 20.

11Section 11

Account Termination & Deletion

We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice, including for violations of these Terms.

You can delete your account at any time — directly in the app (Settings → Delete account) or by emailing [email protected]. Deleting your account immediately ends your access and cancels any active subscription (cancellation stops future renewals; it does not by itself refund the current period). Your personal data is then handled as described in our Privacy Policy.

Upon termination: (a) your right to use the Service ceases immediately; (b) access to your data within the Service is removed; (c) any active paid subscription is cancelled without refund for the remaining period, unless termination was caused by our error.

12Section 12

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY RIGHT OR GUARANTEE YOU HAVE THAT CANNOT BE EXCLUDED UNDER APPLICABLE CONSUMER-PROTECTION LAW (INCLUDING THE QUEBEC CONSUMER PROTECTION ACT, EU/UK CONSUMER LAW, AND THE AUSTRALIAN CONSUMER LAW).

13Section 13

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JDMARKET AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) USD $100.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, GROSS NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. IF YOU ARE A CONSUMER, YOUR NON-WAIVABLE STATUTORY RIGHTS ARE UNAFFECTED BY THIS SECTION.

14Section 14

Indemnification

You agree to indemnify, defend, and hold harmless JDMarket and its owners, operators, employees, and agents from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your misuse of the Service; (c) your violation of any third party's rights; or (d) your own dealings with sellers or other third parties, or your use, re-publication, or redistribution of any listing information obtained through the Service. This indemnity does not extend to claims arising from our own operation of the Service.

15Section 15

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

16Section 16

Modifications to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice by email or by posting a notice within the Service. Your continued use of the Service after the effective date of any modification constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service.

17Section 17

Governing Law & Venue

These Terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict-of-law provisions. Subject to Section 18 (Dispute Resolution), any dispute arising under these Terms shall be resolved in the courts of Montreal, Quebec, and you consent to the personal jurisdiction of such courts.

If you are a consumer, this section does not deprive you of the protection of mandatory consumer-protection provisions of the law of your country or state of residence, or of the right to bring proceedings in the courts of your place of residence where applicable law so requires.

Before initiating any formal proceeding, both parties agree to first attempt to resolve the dispute informally by contacting [email protected] and allowing the other party at least 30 days to respond.

18Section 18

Dispute Resolution; Arbitration & Class-Action Waiver

This Section 18 applies to users located in the United States. To the fullest extent permitted by law, you and JDMarket agree that any dispute that cannot be resolved informally under Section 17 will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court. You and JDMarket waive the right to a jury trial and the right to participate in any class, collective, consolidated, or representative action. Arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules.

Opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms.

This Section 18 does not apply to consumers in the European Union, the United Kingdom, Australia, or any other jurisdiction where pre-dispute arbitration agreements or class-action waivers are not enforceable against consumers. Those users retain all rights described in Section 17 and under their local law.

19Section 19

Third-Party Listing Content & Copyright

The Service surfaces listing content (such as titles, prices, descriptions, and images) that is created and owned by third parties and shown publicly on Facebook Marketplace. We do not claim ownership of that content, and we are not a host for content that you upload.

If you are a rights-holder and believe content surfaced through the Service infringes your rights, or if you are a seller and want listing information about you removed, contact [email protected]. We will review and remove identified content promptly. You can also use the in-app Report / Hide control on any listing.

20Section 20

General Terms

  • Severability. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, if it cannot be, severed, and the remaining provisions remain in full force.
  • Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior or contemporaneous statements, including marketing copy.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them, including in connection with a merger, acquisition, or sale of assets.
  • No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Survival. Provisions that by their nature should survive termination — including Data Accuracy, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution — survive.
  • Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including changes by, or blocking, rate-limiting, or banning by, Meta or Facebook; outages of our infrastructure or proxy providers; network failures; or acts of government, nature, or third parties.
