Description of Service

JDMarket is a software-as-a-service (SaaS) platform that helps users monitor publicly visible listing data from Facebook Marketplace. The Service includes:

• A desktop agent application that browses Facebook Marketplace on behalf of the user using their own logged-in browser session.
• Automated scheduled watches that run searches at user-defined intervals and alert users to new listings.
• AI-powered filtering that evaluates listings against natural-language criteria.
• Telegram notifications delivering new matching listings to the user's Telegram account.
• A web dashboard for managing searches, watches, favorites, and account settings.

The Service is intended for personal use to help individuals find listings of interest. It is not intended as a bulk data collection or commercial redistribution tool.

Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the Service. By registering, you represent and warrant that you meet these requirements. You are also responsible for ensuring that your use of the Service complies with all laws applicable in your jurisdiction.

Acceptable Use

You agree to use the Service only for lawful personal purposes. You must not:

• Use the Service to collect data for commercial resale, redistribution, or mass harvesting without our prior written consent.
• Use the Service to harass, stalk, monitor, or harm any individual.
• Attempt to reverse-engineer, decompile, copy, or reproduce any part of the Service or its underlying code.
• Use automated scripts, bots, or tools (other than our provided agent) to interact with the Service.
• Circumvent, disable, or interfere with any security features, rate limits, or access controls of the Service.
• Share your account credentials, API tokens, or agent authentication with any third party.
• Use the Service in any manner that violates applicable local, national, or international law.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Violation of these rules may result in immediate account suspension or termination without refund.

Account Registration & Security

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized access to your account.

You may not create multiple accounts to circumvent plan limits or access restrictions. We reserve the right to merge or terminate duplicate accounts.

Subscriptions & Billing

JDMarket offers a 3-day free trial of the Pro plan (monthly or annual). All new accounts start on the trial. Stripe collects a payment method during checkout but no charge is made for 3 days. After the trial, the subscription converts to recurring billing at the chosen cadence (monthly or annual) unless cancelled before the trial ends.

• Free trial: 3 days of full Pro access with no charge. Cancel anytime before the trial ends from your profile to avoid being billed.
• Monthly Pro: After the trial, billed every 30 days at the then-current monthly rate.
• Annual Pro: After the trial, billed once per year at the then-current annual rate. Access is granted for a full 12-month period.

By subscribing to a paid plan, you authorize us (through Stripe) to charge your payment method on a recurring basis until you cancel. All prices are displayed in USD unless otherwise stated. Applicable taxes may be added based on your location.

We reserve the right to change our pricing at any time. We will provide at least 14 days' notice before any price increase takes effect for existing subscribers.

Refunds & Cancellations

You may cancel your subscription at any time from your profile page or billing portal. Cancellation takes effect at the end of your current billing period — you retain Pro access until then. We do not offer prorated refunds for unused time on monthly plans.

Annual plans: If you cancel an annual plan within 7 days of the initial purchase and have not used the Service substantially (fewer than 3 completed scrapes), you may request a full refund by contacting [email protected]. After 7 days, annual plans are non-refundable.

We reserve the right to grant refunds at our discretion on a case-by-case basis for exceptional circumstances.

Third-Party Platforms

The Service retrieves publicly available data from Facebook Marketplace, a third-party platform operated by Meta Platforms, Inc. You acknowledge and agree that:

• You are solely responsible for ensuring your use of data obtained through the Service complies with Facebook's Terms of Service and all applicable laws in your jurisdiction.
• JDMarket makes no representations regarding the legality of automated access to Facebook Marketplace in your jurisdiction.
• Meta may modify, restrict, or shut down its platform at any time, which may affect or disable the Service. JDMarket is not liable for any interruption resulting from such changes.
• The agent application browses Facebook Marketplace using your own Facebook account and session. You are responsible for any consequences arising from your use of Facebook through our agent.

The Agent Application

To use the monitoring features of JDMarket, you must download and run our desktop agent application ("the Agent") on a Windows computer. By running the Agent, you acknowledge that:

• The Agent runs locally on your computer and uses your own Facebook login session to browse Marketplace on your behalf.
• The Agent communicates with JDMarket servers to receive job instructions and report results. This communication is encrypted (HTTPS).
• You must keep your computer powered on and connected to the internet for monitoring to be active.
• You are responsible for maintaining the security of the computer running the Agent.
• We may release updates to the Agent from time to time. Continued use of the Service may require installing available updates.

The Agent does not take any action on Facebook other than browsing — it does not post, message, buy, or interact with listings in any way.

Data Accuracy

The Service retrieves and displays data as it appears publicly on Facebook Marketplace at the time of the scrape. We do not verify the accuracy, completeness, availability, or legality of any listing. JDMarket makes no warranty that scraped data is accurate, current, or complete.

Listings may be removed, altered, or sold between the time they are scraped and the time you view them. You assume full responsibility for any decisions — financial or otherwise — made based on data obtained through the Service.

Service Availability

We strive to maintain reliable uptime, but we do not guarantee that the Service will be available at all times. The Service may be suspended, modified, or discontinued at any time — for maintenance, technical issues, or other reasons — without prior notice. We are not liable for any losses resulting from service interruptions, downtime, scrape failures, or discontinuation.

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice, including for violations of these Terms. You may request account deletion at any time by contacting [email protected].

Upon termination: (a) your right to use the Service ceases immediately; (b) access to your data within the Service will be removed; (c) any active paid subscription will be cancelled without refund for the remaining period, unless termination was caused by our error.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JDMARKET AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) $50 CAD.

Indemnification

You agree to indemnify, defend, and hold harmless JDMarket and its owners, operators, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your use of the Service; (c) your violation of any third party's rights, including Meta's Terms of Service; or (d) any data or content you access or obtain through the Service.

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

Modifications to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice by email or by posting a notice within the Service. Your continued use of the Service after the effective date of any modification constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the courts of Montreal, Quebec, and you consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceeding, both parties agree to attempt to resolve disputes informally by contacting [email protected] and giving the other party at least 30 days to respond.
